General Terms and Conditions of Minka Holz- und Metallverarbeitungs GmbH
1. scope of application
1.1. Die nachstehenden Allgemeinen Geschäftsbedingungen der Minka Holz- und Metallverarbeitungs GmbH, Flurgasse 6, AT-8642 St. Lorenzen im Mürztal gelten ausschließlich; entgegenstehende oder von diesen Bedingungen abweichende Bedingungen des Kunden erkennt Minka Holz- und Metallverarbeitungs GmbH nicht an. Minka Holz- und Metallverarbeitungs GmbH ist verantwortliche Betreiberin und Anbieterin des Onlineshops unter der Webadresse www.minka.at.
1.2. “Entrepreneur” within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding the legal transaction with Minka Holz- und Metallverarbeitungs GmbH, acts in the exercise of a commercial or independent professional activity (§14 BGB).
1.3. “Consumer” within the meaning of these GTC is the customer who concludes a legal transaction with Minka Holz- und Metallverarbeitungs GmbH for a purpose that cannot be attributed to either his commercial or his independent professional activity (§ 13 BGB).
1.4. “Distance contracts” are contracts for the supply of goods or the provision of services concluded between Minka Holz- und Metallverarbeitungs GmbH and a consumer using exclusively means of distance communication.
2. offer and conclusion of contract
2.1. The presentation of products in the online store www.minka.at does not constitute a legally binding offer, but an invitation to order. All products offered are valid “while stocks last”, unless otherwise stated on the product pages. All dimensions and weights stated are approximate. The items shown may differ in color and size from the item selected by the customer.
2.2. By clicking the [Buy] button in the order process, the customer submits a binding offer to purchase the items listed in his shopping cart. Immediately after placing his order, the customer receives an automatically generated “order confirmation” from Minka Holz- und Metallverarbeitungs GmbH by e-mail, which informs the customer that his order has been received by Minka Holz- und Metallverarbeitungs GmbH. This order confirmation does not constitute a legally binding acceptance by Minka Holz- und Metallverarbeitungs GmbH. Minka Holz- und Metallverarbeitungs GmbH may accept the customer’s order by sending an order confirmation by e-mail or by delivering the goods within two days.
3. terms of payment
3.1 The prices listed at the time of the order shall apply. Unless clearly indicated as “excl. VAT”, all prices are inclusive of statutory VAT.
3.2 Payment for the goods shall be made at the customer’s discretion using one of the payment methods displayed during the order process. If payment is made in advance by bank transfer, the purchase price is due upon conclusion of the contract, i.e. upon receipt of the order confirmation. If payment is made by credit card via PayPal, the customer’s credit card account will be debited with the order value immediately after completion of the order process.
3.3 Minka Holz- und Metallverarbeitungs GmbH reserves the right, in individual cases or if payment is refused by credit institutions or providers of the respective payment method, to execute the customer’s order only against payment in advance. In this case, the customer can accept this or, if he has already sent his order, withdraw from his order.
3.4 Minka Holz- und Metallverarbeitungs GmbH shall only send an invoice electronically by e-mail. The customer expressly agrees to the transmission of an electronic invoice. However, the customer is entitled to request the transmission of an invoice by post at any time.
4. delivery / delivery time / retention of title
4.1 The delivery times depend on the product and are indicated with the corresponding products. Collection of the goods is only possible after separate consultation and agreement.
4.2 If an ordered product cannot be delivered on time because Minka Holz- und Metallverarbeitungs GmbH is not supplied with this product by its supplier on time, the customer shall be informed immediately. In such a case, the customer is free to wait for the ordered product or to cancel his order. In the event of cancellation, any payments already made will be refunded immediately.
5. prices and shipping costs
5.1 The prices stated on the product pages include statutory VAT.
5.2 In addition to the prices quoted, a flat-rate shipping fee of € 29.90 will be charged.
5.3 The shipping costs incurred for the customer’s order are displayed in the shopping cart. If the customer wishes delivery to other European countries, this is only possible by prior and separate agreement.
6. contract language, codes of conduct
6.1 The contract language is German. Only the German language is available for the conclusion of the contract.
6.2 Minka Holz- und Metallverarbeitungs GmbH is not subject to any special codes of conduct.
